Furthermore, Subscriber agrees NOT to:
· Reverse engineer, disassemble, decompile or otherwise attempt to derive the source code (including tools, methods, processes, and infrastructure) of the SupportHound case data or suggested award analysis.
· Mirror image SupportHound.
· Upload or transmit any form of virus, worm, Trojan horse, or other malicious code to SupportHound.
· Use any automatic, electronic, or manual process to harvest information from SupportHound (including, but not limited to, robots, spiders, and/or scripts).
· Impersonate any person or entity, or otherwise misrepresent your affiliation with a person or entity.
· Disrupt or interfere with the security of SupportHound.
· Probe, scan, test, or breach the vulnerability of SupportHound.
Subscription Fee. In order to create an account for use of SupportHound, Subscriber is required to provide credit card information for billing. Subscriber can choose between a monthly reoccurring subscription, an annual reoccurring subscription, a monthly non-reoccurring subscription, or a daily non-reoccurring subscription, which are referred to herein as “Subscription Fee.” Subscriber’s credit card will be charged daily, monthly, or annually, (accordingly) prior to the beginning of the subscription. If Subscriber is enrolled in a re-occurring subscription, and the Subscriber cancels the subscription, Subscriber’s account access will be terminated the day prior to the next scheduled reoccurring charge on Subscriber’s credit card. If the Subscriber is enrolled in a non-reoccurring subscription, Subscriber’s account access will be terminated the day following the non-reoccurring term.
DISCLAIMER OF WARRANTY. SUBSCRIBER UNDERSTANDS THAT SUPPORTHOUND ONLY TRACKS THE OUTCOME OF CIRCUIT COURT CASES AND DOES NOT TRACK CASES THAT ARE APPEALED. SUBSCRIBER AGREES THAT IT IS SUBSCRIBER’S SOLE RESPONSIBILITY TO RESEARCH THE ULTIMATE AWARD FOR EACH CASE CITED BY SUPPORTHOUND.
SupportHound does not guarantee and makes no warranty that the features and functions contained or related to SupportHound will be uninterrupted or error-free, that the server used for SupportHound will be free of viruses or other harmful components, and/or that any defects will be corrected even if SupportHound is aware of these problems. Subscriber assumes the entire cost of all servicing, repair, or correction that may be necessary as a result of any viruses, errors, or any other problems whatsoever that Subscriber may have as a result of using or accessing SupportHound.
Limitation of Liability. Under no circumstances shall SupportHound be liable for any damages or injury, including any direct, special, incidental, consequential, punitive or other damages that may result from the use of, or the inability to use, SupportHound, whether in an action of contract, negligence, or other tortious action, arising out of, or in connection with, Subscriber’s use of or access to SupportHound.
SupportHound shall not be liable, even if SupportHound or an authorized representative of SupportHound has been advised of the possibility of such damages. These include but are not limited to damages or injury caused by error, omission, interruption, defect, failure of performance, delay in operation or transmission, line failure, computer virus, worm, malicious code, or other harmful component. In no event shall SupportHound’s total liability for damages, losses, and causes of action, whether in contract, tort (including but not limited to negligence), or otherwise, exceed the amount paid by Subscriber to SupportHound during the 30-day period immediately preceding the date of the alleged event giving rise to liability.
Links To Other Web Sites. SupportHound may contain links to third party web sites or services. SupportHound assumes no responsibility for the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that SupportHound shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by, or in connection with the use of, or reliance upon, any such content or services available on or through any websites or services. We strongly advise you to read the terms and conditions and privacy policies of any third party web sites or services that you visit.
Indemnification. Subscriber will defend and indemnify SupportHound for, from, and against any and all claims, actions, proceedings, damages, liabilities, and expenses of every kind, including but not limited to reasonable attorney fees, resulting from or arising out of any claim relating to Subscriber’s use of SupportHound.
Class Action Waiver. Subscriber waives any right to join Subscriber’s claim, action, or dispute with any other person or entity. All claims and disputes must be litigated on an individual basis, and claims of more than one Subscriber, entity, or individual cannot be jointly litigated or consolidated.
