PLEASE CAREFULLY READ THESE TERMS OF USE (HEREIN “TERMS OF USE”) BEFORE USING OR ACCESSING WWW.SUPPORTHOUND.COM ALSO KNOWN AS “SUPPORTHOUNDTM,” WHICH IS OPERATED BY SUPPPORTHOUND, LLC, AND ARE COLLECTIVELY REFEREED TO IN THESE TERMS OF USE AS “SUPPORTHOUND.” BY CREATING AN ACCOUNT TO USE SUPPORTHOUND, I, ON BEHALF OF MYSELF OR THE ENTITY I REPRESENT (HEREIN “SUBSCRIBER”), AGREE TO THESE TERMS OF USE. ACCESS AND USE OF SUPPORTHOUND IS CONDITIONED UPON ACCEPTANCE TO THESE TERMS OF USE.

By using SupportHound, Subscriber agrees to be bound by these Terms of Use, which may be changed, amended, or revised without notice to Subscriber. SupportHound encourages Subscriber to make full use of SupportHound, subject to the Terms of Use. If Subscriber does not agree to the Terms of Use, Subscriber shall not use or access SupportHound. Subscriber’s continued use of SupportHound reaffirms Subscriber’s agreement to strictly abide by the Terms of Use. By continuing to access SupportHound after revisions to either SupportHound or Terms of Use become effective, Subscriber agrees to be bound by the revised Terms of Use. Failure by Subscriber to discontinue use when Subscriber is not in agreement to the Terms and Use, revised or otherwise, does not constitute waiver on the part of SupportHound to enforce revised terms.

Ownership of SupportHound. SupportHound is the owner of all copyright, trademark, design, layout, look, appearance, graphics, patent and other intellectual property rights (whether registered or unregistered) related to SupportHound. SupportHound reserves all rights. Nothing in these Terms of Use grants Subscriber a right or license to use any intellectual property except as expressly provided by these Terms of Use. SupportHound may, in its sole discretion, modify SupportHound at any time without notice to Subscriber. SupportHound may, in its sole discretion, maintain or discontinue SupportHound and will post any discontinuance notice on the main page of SupportHound.

General Use and Limited License. Upon payment of Subscription Fee and subject to Subscriber’s compliance with these Terms of Use, SupportHound grants Subscriber a nonexclusive, revocable, limited, non-transferable, non-sublicensable, fee-based license to access and use SupportHound with an assigned login (“Login”). The Login is personal to Subscriber and may not be transferred to any third party. Subscriber shall not allow any third party to use Subscriber’s Login to access or use SupportHound. Subscriber may access and use (including printing, copying, sharing and distributing) SupportHound for the sole purpose of negotiating, mediating, and/or litigating spousal support issues, and for no other purposes. Subscriber’s use of, or access to, SupportHound other than specifically authorized by these Terms of Use, without the prior written permission of SupportHound is strictly prohibited and SupportHound reserves the right to immediately terminate the license upon any unauthorized use. Unauthorized use of SupportHound may give rise to a claim for damages.

Furthermore, Subscriber agrees NOT to:

· Reverse engineer, disassemble, decompile or otherwise attempt to derive the source code (including tools, methods, processes, and infrastructure) of the SupportHound case data or suggested award analysis.

· Mirror image SupportHound.

· Upload or transmit any form of virus, worm, Trojan horse, or other malicious code to SupportHound.

· Use any automatic, electronic, or manual process to harvest information from SupportHound (including, but not limited to, robots, spiders, and/or scripts).

· Impersonate any person or entity, or otherwise misrepresent your affiliation with a person or entity.

· Disrupt or interfere with the security of SupportHound.

· Probe, scan, test, or breach the vulnerability of SupportHound.

Subscription Fee. In order to create an account for use of SupportHound, Subscriber is required to provide credit card information for billing. Subscriber can choose between a monthly reoccurring subscription, an annual reoccurring subscription, a monthly non-reoccurring subscription, or a daily non-reoccurring subscription, which are referred to herein as “Subscription Fee.” Subscriber’s credit card will be charged daily, monthly, or annually, (accordingly) prior to the beginning of the subscription. If Subscriber is enrolled in a re-occurring subscription, and the Subscriber cancels the subscription, Subscriber’s account access will be terminated the day prior to the next scheduled reoccurring charge on Subscriber’s credit card. If the Subscriber is enrolled in a non-reoccurring subscription, Subscriber’s account access will be terminated the day following the non-reoccurring term.

DISCLAIMER OF WARRANTY. SUBSCRIBER UNDERSTANDS THAT SUPPORTHOUND ONLY TRACKS THE OUTCOME OF CIRCUIT COURT CASES AND DOES NOT TRACK CASES THAT ARE APPEALED. SUBSCRIBER AGREES THAT IT IS SUBSCRIBER’S SOLE RESPONSIBILITY TO RESEARCH THE ULTIMATE AWARD FOR EACH CASE CITED BY SUPPORTHOUND.

Subscriber agrees that SupportHound is provided for use by Subscriber “as is” and on an “as available” basis, with all faults. SupportHound makes no warranty regarding the operation of SupportHound. Subscriber acknowledges that SupportHound may contain inaccuracies or errors and SupportHound expressly excludes liability for any such inaccuracies or errors to the fullest extent permitted by law. SupportHound expressly disclaims any and all warranties, express or implied, including but not limited to any warranties as to the availability, accuracy, timeliness, performance, error, deliver, completeness, implied warranties of merchantability, fitness for a particular purpose, non-infringement of intellectual property, title, operability, condition, quiet enjoyment, value, and/or accuracy of data. No content, advice, or information obtained by Subscriber from SupportHound will create any warranty, representation, or guarantee not expressly stated in these Terms of Use.

SupportHound does not guarantee and makes no warranty that the features and functions contained or related to SupportHound will be uninterrupted or error-free, that the server used for SupportHound will be free of viruses or other harmful components, and/or that any defects will be corrected even if SupportHound is aware of these problems. Subscriber assumes the entire cost of all servicing, repair, or correction that may be necessary as a result of any viruses, errors, or any other problems whatsoever that Subscriber may have as a result of using or accessing SupportHound.

Limitation of Liability. Under no circumstances shall SupportHound be liable for any damages or injury, including any direct, special, incidental, consequential, punitive or other damages that may result from the use of, or the inability to use, SupportHound, whether in an action of contract, negligence, or other tortious action, arising out of, or in connection with, Subscriber’s use of or access to SupportHound.

SupportHound shall not be liable, even if SupportHound or an authorized representative of SupportHound has been advised of the possibility of such damages. These include but are not limited to damages or injury caused by error, omission, interruption, defect, failure of performance, delay in operation or transmission, line failure, computer virus, worm, malicious code, or other harmful component. In no event shall SupportHound’s total liability for damages, losses, and causes of action, whether in contract, tort (including but not limited to negligence), or otherwise, exceed the amount paid by Subscriber to SupportHound during the 30-day period immediately preceding the date of the alleged event giving rise to liability.

Links To Other Web Sites. SupportHound may contain links to third party web sites or services. SupportHound assumes no responsibility for the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that SupportHound shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by, or in connection with the use of, or reliance upon, any such content or services available on or through any websites or services. We strongly advise you to read the terms and conditions and privacy policies of any third party web sites or services that you visit.

Indemnification. Subscriber will defend and indemnify SupportHound for, from, and against any and all claims, actions, proceedings, damages, liabilities, and expenses of every kind, including but not limited to reasonable attorney fees, resulting from or arising out of any claim relating to Subscriber’s use of SupportHound.

Termination. SupportHound may, in its sole discretion, terminate or suspend Subscriber’s access to SupportHound without prior notice or liability, for any reason whatsoever, including, but not limited to, breach of these Terms of Use. Additionally, SupportHound may also terminate Subscriber’s subscription if SupportHound is unable to charge Subscriber’s credit card. Upon termination, Subscriber will not be entitled to receive any refund or compensation of any kind relating to the termination of Subscriber’s access to SupportHound. All provisions of the Terms of Use shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Applicable Law and Jurisdiction. Subscriber agrees and understands that Subscriber’s use of and access to SupportHound is subject to all applicable, local, state, federal, and international laws and regulations. Except for federal subject matter, these Terms of Use and any disputes arising under or related to these Terms of Use (whether for breach of contract, tortious conduct, or otherwise) will be governed by Oregon state laws, without reference to conflicts of law principles. Subscriber further agrees that any legal actions, suits or proceedings arising out of these Terms of Use (whether for breach of contract, tortious conduct, or otherwise) will be brought exclusively in the Oregon state courts or the United States Oregon District Court, and Subscriber hereby accepts and submits to the personal jurisdiction of these Oregon courts with respect to any legal actions, suits or proceedings arising out of these Terms of Use.

Class Action Waiver. Subscriber waives any right to join Subscriber’s claim, action, or dispute with any other person or entity. All claims and disputes must be litigated on an individual basis, and claims of more than one Subscriber, entity, or individual cannot be jointly litigated or consolidated.

Jury Trial Waiver. Subscriber also waives its constitutional and statutory right to a trial by jury in any action, suit, or proceeding brought to enforce, defend or interpret any right or remedies under, or arising in connection with or relating to these Terms of Use.

Severability and Entire Agreement. If any provision in these Terms of Use shall be found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms of Use and shall not affect the validity and enforceability of any remaining provisions. These Terms of Use constitute the entire agreement between Subscriber and SupportHound with respect to Subscriber’s access to and use of SupportHound and it supersedes all prior or contemporaneous communications and proposals (if any), whether electronic, oral, or written, between Subscriber and SupportHound with respect to the SupportHound. A printed version of these Terms of Use and of any notice given in electronic form will be admissible in judicial or administrative proceedings based upon, or relating to, Subscriber’s use of SupportHound.

No Waiver. No failure on the part of SupportHound to enforce any part of these Terms of Use shall constitute a waiver of any of SupportHound’s rights under these Terms of Use, whether for past or future actions on the part of any person. Neither the receipt of any funds by SupportHound, nor the reliance of any person on SupportHound’s actions shall be deemed to constitute a waiver of any provision of these Terms of Use. Only a written waiver signed by an authorized representative of SupportHound shall have the legal effect of waiving any provision contained in these Terms of Use.

Privacy. Your use of the service is subject to Support Hound’s Privacy Policy. Please review our Privacy Policy, which governs the site and our practices.
